Question:
Assalamu Alaikum... our Sheikh.. is it possible to give me a decisive response to those who say that we are not bound by the method of the Messenger (saw) in reaching power and building a state...?
Answer:
Wa Alaikum Assalam Wa Rahmatullahi Wa Barakatuh,
Briefly, the decisive response is as follows:
1- Ask the one who says that we are not bound by the method of the Messenger (saw) in reaching power:
Ask him, if you want to perform ablution (wudu), for what evidence do you look to know how to perform it? Do you not look for the evidences of wudu? Or do you look for the evidences of Hajj, for example? He will say that he looks for the evidences of wudu...
Then ask him, if you want to know the rules of fasting, do you not look for the evidences of fasting? Or do you look for the evidences of Jihad to know how to fast? He will answer that he looks for the evidences of fasting to know its rulings.
Then ask him, if you want to know the rulings of prayer (salah), do you not look for the evidences of prayer? Or do you look for the evidences of zakat? He will answer that he looks for the evidences of prayer.
Thus, for any matter he wants to know its rulings, he will search for its evidences in the Shari'ah.
Now, ask him about knowing how to establish the state: Does he not look for the Shari'ah evidences mentioned regarding the Messenger (saw) on how to establish the state? He should not look for the evidences of Jihad, for example, or prayer, or zakat... rather, he must look for the evidences of establishing the state. The Messenger (saw) established the state once through the method of seeking support (Talab an-Nusrah) during the interaction stage (Marhalat at-Tafa’ul). Therefore, the method of establishing the state is seeking support (Talab an-Nusrah).
The question now is: is seeking support (Talab an-Nusrah) an obligation (fard), recommended (mandub), or permissible (mubah)...? If seeking support is an obligation, then we are bound by this method in establishing the state. By studying this subject, we find the following:
Seeking support (Talab an-Nusrah) is an obligation (fard). The evidence for this is that the Messenger (saw) did not change this method despite the hardship he encountered while seeking it. He sought it from Thaqif, and they rejected him harshly and caused his feet (saw) to bleed... yet the Messenger of Allah (saw) did not change it to another method. Instead, he (saw) continued seeking support from the tribes; he sought it from Bani Shayban, Bani Amir... etc. He sought it over a dozen times, and they did not respond. Despite this, the Messenger (saw) did not change it to another method despite the hardship involved. In the foundations of jurisprudence (Usul), the repetition of a request despite hardship is an indication (qarinah) that this request is an obligation (fard).
Meaning that seeking support (Talab an-Nusrah) is an obligation... and it is the only method followed by the Messenger (saw) in establishing the state. He persisted in it until Allah honored him with the Ansar, who gave him the second pledge of allegiance at Al-Aqabah (Bay’at al-Aqabah ath-Thaniyah), after which he migrated to Medina and established the state.
This is a summary for:
لِمَنْ كَانَ لَهُ قَلْبٌ أَوْ أَلْقَى السَّمْعَ وَهُوَ شَهِيدٌ
"For whoever has a heart or lends an ear while he is heedful." (Surah Qaf [50]: 37)
As for the obstinate, their argument is refuted because any one of them acknowledges searching for the evidences of wudu to perform ablution, acknowledges searching for the evidences of fasting to fast, and acknowledges searching for the evidences of prayer to pray... and he does not search for evidences for an action other than the one he intends to perform. It is his duty, if he is rational, to acknowledge searching for the evidences of establishing the state if he wants to establish a state. There are no evidences clarified by the Messenger (saw) through his actions and words except seeking support (Talab an-Nusrah), which the Messenger (saw) performed at the end of the interaction stage... and this method is an obligation (fard). This, in short, is the decisive and sufficient response regarding the obligation of the method we follow in establishing the state.
In conclusion, I send you my greetings of peace, and I ask Allah (swt) to open the doors of goodness at your hands.
Your Brother, Ata Bin Khalil Abu Al-Rashtah
