Question:
Assalamu Alaikum Wa Rahmatullah Wa Barakatuh
Is it permissible for a woman to uncover her hijab before her father's paternal uncle and her mother's maternal uncle?
May Allah bless you, my dear brother.
Answer:
Walaikum Assalam Wa Rahmatullah Wa Barakatuh
Allah (swt) says:
"Prohibited to you [for marriage] are your mothers, your daughters, your sisters, your father's sisters, your mother's sisters, your brother's daughters, and your sister's daughters..." (QS An-Nisa [4]: 23)
Thus, it is forbidden for a man to marry his brother’s daughters, his brother’s sons’ daughters, and the entire lineage below that—meaning his brother’s granddaughters, his brother’s sons’ granddaughters, and so on. Therefore, a woman’s father’s paternal uncle is one of her maharim (unmarriageable kin) because she is the daughter of his brother’s son.
Similarly, it is forbidden for a man to marry his sister’s daughters, his sister’s sons’ daughters, and the entire lineage below that—meaning his sister’s granddaughters, his sister’s sons’ granddaughters, and so on. Therefore, a woman’s mother’s maternal uncle is one of her maharim because she is the daughter of his sister’s daughter.
Your brother, Ata Bin Khalil Abu al-Rashtah
