Q&A: What lies behind India's Revocation of Kashmir's Special Status?

Question:

(The White House stated in a press release that US President Trump told Pakistani Prime Minister Imran Khan in a phone call on Friday that it is important for India and Pakistan to seek to reduce tensions in Jammu and Kashmir through bilateral dialogue. Trump says this at a time when Modi boasts of officially annexing Kashmir, claiming it is no longer a matter of dispute between India and Pakistan (The Indian Prime Minister Modi said on 15/08/2019 in a speech on the occasion of India's Independence Day that his government was able to achieve what all previous Indian governments failed to do... Asharq Al-Awsat 16/08/2019)!

The Question is: What is the use of dialogue when India has officially annexed Kashmir? Why has Pakistan not taken the correct measure to liberate Kashmir through Jihad, especially since it is capable of doing so with its army? Furthermore, does America have a role in this? May Allah reward you with goodness.

Answer:

To clarify the answer, we review the following matters:

  1. Among all regions of the world, the Eurasian region is the most important for American foreign policy planners. America exerts every effort to ensure that no rival emerges in that region. There are four potential competitors: Russia, China, Germany, and the Khilafah... However, it views the actual competitor now as China. Since the fall of the Soviet Union, American strategists have viewed China as the greatest threat to American interests. Practically, American strategists have utilized the Asia-Pacific countries to sabotage China's rise as a naval power and employed the Indian subcontinent to confront China's rise as a dominant power in Eurasia. While America was strengthening its capabilities in the Asia-Pacific region through numerous alliances with Taiwan, Thailand, Vietnam, the Philippines, Japan, Indonesia, and Australia, no major alliance occurred in the Indian subcontinent—especially with India—until Vajpayee took office in the late 1990s. The peak of exploiting India occurred after President Clinton's visit in 2000. Shortly after the events of September 11, 2001, the Bush administration focused on India, and a large portion of American measures were directed toward bridging the military gap between India and China according to American programs... Among these measures was the US nuclear deal with India.

  2. America perceived that tensions over Kashmir between India and Pakistan weaken the Indian subcontinent's stance against China. To overcome these tensions, the United States began a normalization process between India and Pakistan. The goal of normalization was to neutralize Indian and Pakistani forces from fighting each other over Kashmir and to direct efforts toward cooperation with the United States to ultimately restrict the rise of China. America thought that India's annexation of Kashmir and American pressure on the regime in Pakistan—to prevent it from reclaiming it militarily and to move the issue to dialogue—would kill the cause and prevent military conflict between them. This is similar to the status of the Abbas authority in Palestine and the surrounding Arab states, which remain without military conflict with the Jewish state while the latter occupies and annexes whatever they wish of Palestine! Thus, Modi began the plan to annex Jammu and Kashmir and change its demographics. Subsequently, the decision was taken by Modi on 05/08/2019 to repeal Article 370 of their constitution regarding Kashmir. This article granted the region a great deal of autonomy, allowing Kashmir to have its own constitution, a separate flag, and independence in many matters except for foreign affairs, defense, and communications. The revocation decision was issued under the name "Reorganization" Act, which divides occupied Kashmir into two regions: the Jammu and Kashmir region and the Ladakh region, linking the administration of both regions to the federal government in New Delhi. The upper house of the Indian Parliament, the Rajya Sabha, approved the bill the following day, 06/08/2019, with 125 in favor and 61 against. Article 35A was also revoked, which had prohibited non-Kashmiris from buying property and land in Kashmir. This will pave the way for other Indians in the rest of the states to come to Kashmir, buy property and land, and apply for government jobs there, causing a demographic and cultural change in the Muslim-majority region... This is similar to the Jewish state's measures in its annexation activities in Palestine! Just as what Netanyahu does is with American approval and a green light, so too is Modi acting with American approval and a green light... meaning Modi has replicated Netanyahu's approach in Palestine with American approval and support.

  3. When India announced its recent decision to revoke Kashmir's special status, Pakistan's position was also shameful, not exceeding condemnation to save face. The Pakistani Foreign Ministry issued a statement saying: "Pakistan strongly condemns and rejects the announcement issued on Monday (05/08/2019) from New Delhi, and that no unilateral step by the Government of India can change the disputed status. As a party to this international dispute, Pakistan will exercise all possible options to counter the illegal steps" (AFP 05/08/2019). The Pakistani Ambassador to Moscow, Qazi Khalilullah, said: "Pakistani authorities are currently focusing on preparing diplomatic, political, and legal responses to the recent Indian measures in Kashmir, and a special committee has been formed that will submit recommendations to the government in this regard." This is exactly as the Abbas authority and the surrounding Arab states do, where they condemn and protest the Jewish state's violations of the Blessed Land of Palestine without moving armies to fight. Pakistan is repeating the same role, condemning without moving the army to fight! Furthermore, they resort to the United Nations and America to solve their issues, even though they are the enemy, so beware of them!

  4. This is supported by Pakistani Prime Minister Imran Khan’s tweets on 11/08/2019, describing India’s move as leading to "the oppression of Muslims in India and will eventually lead to targeting Pakistan, and it is an attempt to change the demographic situation in Kashmir through ethnic cleansing." He asked the so-called international community to intervene, claiming this international community has the power to deter India! Pakistan forgets that it possesses the power to deter India... and this is a witnessed fact. India announced on 26/02/2019 that it carried out an airstrike on Kashmiri group camps and that it "killed a large number in these camps." This followed an announcement that Kashmiri groups carried out an operation against the Indian occupation army in Kashmir, killing 41 Indian soldiers on 14/02/2019. Pakistan announced the day after that Indian attack that it had shot down two Indian planes, captured a pilot, and killed two... This indicates the army's ability to deter and defeat India. However, the Pakistani regime is not serious about taking any steps to deter India; rather, the regime complies with the orders of America, which requested no escalation in the incident of shooting down the two planes. News reports indicated that ("US Secretary of State Pompeo spoke by phone with his Indian and Pakistani counterparts following the Indian raid on the Jaish-e-Mohammed camp and issued a statement urging both sides to de-escalate and avoid any move that would seriously escalate the danger." In fact, he stood by India when the American added: "Indian airstrikes were counter-terrorism actions, and urged Pakistan to take serious action against terrorist groups operating on its territory"... AFP, Reuters 28/02/2019). This statement shows the extent of American bias toward India and its support for what it does, just as it does in Palestine, where it always sides with the Jewish entity and supports it in everything it does against the Muslims who defend their land and work to liberate it... Nevertheless, Pakistan, like the Abbas authority and the Arab regimes, has not broken its habit of resorting to America and waiting for it to intervene to solve the problem for it, even though it realizes that America stands with India. The Pakistani Ambassador to Washington, Majeed Khan, stated on 27/02/2019 that (The statement "of the US Secretary of State" was interpreted and understood as an endorsement of the Indian position, and this is what encouraged them [the Indians] more) and said: ("Perhaps there is no other country in a better position than the United States to play a role"... AFP 28/02/2019). Even though he admits that the State Department statement is an endorsement of the Indian position, he believes that America is the one qualified to play the role! This is typical of America, to distract them with the Security Council and the United Nations... This is what the Pakistani regime did, announcing that it does not want tension and escalation with India, and that it would submit a formal protest to the United Nations against New Delhi, nothing more, nothing less. In fact, the regime announced that it would hand over the murderous Indian pilot to India and actually handed him over as a "gesture of peace" according to its claim... Likewise, later, upon the annexation of Kashmir, Pakistan called for (a special closed-door session of the UN Security Council regarding the situation in the Kashmir region following India's decision to revoke the region's autonomy... The Pakistani representative to the UN, Maleeha Lodhi, welcomed the Security Council's decision to discuss the Kashmir issue during a special session, saying that the Kashmir issue is beginning to be raised globally and that it is ready for a solution with India through dialogue. Al-Araby Al-Jadeed 16/08/2019)!

  5. This position indicates that the Pakistani regime will not take military steps to deter India and will not carry out any serious action against it, which solidifies India's decision to revoke Kashmir's special status and solidifies the occupation. Note that Imran Khan, during his visit to America on 21/07/2019, accompanied by the Pakistani Army Chief Javed Bajwa and the Director-General of Inter-Services Intelligence (ISI) Faiz Hameed, requested during his meeting with Trump that he play a role for America's account in Afghanistan, saying: "He hopes that Pakistan will help in mediating to reach a political settlement to end the 18-year war in Afghanistan." Imran Khan immediately complied with Trump's orders, saying: ("I will meet with the Taliban and I will do my best to convince them to enter into talks with the Afghan government." Then he boasted of the Pakistani regime's betrayal and its services to America, saying: "Pakistani intelligence provided the information that allowed the [Americans] to locate Osama bin Laden"... Reuters 22/07/2019). All this he offers to the Americans at a time when they support India at the expense of Pakistan! When India's announcement of revoking Kashmir's special status came, the US State Department issued a statement saying: "We continue to support direct dialogue between India and Pakistan on Kashmir and other issues of concern"... (Reuters 07/08/2019). America did not condemn India's move or say it contradicts international resolutions regarding Kashmir; rather, it spoke of dialogue in mockery of Imran and his regime. What dialogue is there when India officially announces the annexation of Kashmir?! This indicates American approval of this step; rather, it indicates America's prior knowledge of it, because India could not take such a step before consulting America and taking the green light from it.

  6. It was stated in our book Political Issues - Occupied Muslim Lands issued on 21/05/2004 regarding the Kashmir issue: ("Therefore, since both India and Pakistan have come under its influence, America has begun to work diligently to find an understanding between them over Kashmir. It changed its basic view of solving the issue; whereas initially, it wanted to internationalize the issue, it is now urging both parties to solve it bilaterally between them. America's view of this solution now includes the division of Kashmir, such that liberated Kashmir belongs to Pakistan, and the Kashmir under Indian control belongs to India.") What is happening now matches what was stated in our book. India has taken this step and created a new fait accompli that solidifies the Indian occupation of Kashmir.

  7. China condemned India's move. The decision to revoke Article 370 was issued under the "Reorganization" Act, dividing occupied Kashmir into two regions: Jammu and Kashmir, and Ladakh, linking the administration of both to the federal government in New Delhi... especially since Ladakh in the Kashmir region is located on the Tibetan plateau near China. India did not consult China before this law. Therefore, Hua Chunying, spokesperson for the Chinese Foreign Ministry, stated that "the Indian side in recent times has continued to undermine China's territorial sovereignty by changing its domestic laws related to borders without referring to Beijing, and that China cannot accept these practices... Ying's statements came in response to New Delhi's decision last Monday to declare Ladakh a union territory, which includes within its area the western part of the Sino-Indian border. Chunying stressed that China always opposes India's inclusion of Chinese territory in the western part of the border under the name of an Indian administrative state..." (Al-Bayan 08/08/2019).

8. We conclude from the above the following points:

a- The revocation of Article 370 and the subsequent annexation measures taken by Modi are with a green light from America and its support, thinking that annexation will make Muslims forget Kashmir and that India and Pakistan will exist without problems between them, considering that both regimes are currently following the American line... America and India have forgotten, or pretend to forget, that Kashmir is in the hearts of Muslims in Pakistan and everywhere, just like any other occupied Islamic land.

b- The Pakistani regime's approval or silence regarding India's annexation of Kashmir does not in any way mean the silence of the Muslims in Pakistan or the silence of their armies... India is well aware of the strikes of this army, and the shooting down of the two Indian planes is not far off... These army strikes occurred while the Imran regime prevents the army from attacking to liberate Kashmir, only allowing it to defend, and even that with restrictions! So how would it be if they were mobilized for war? Then the enemy would surely see from them what would be its destruction!

c- China condemned India's move. The Chinese Foreign Ministry issued a statement saying: "India's decision is unilateral and reflects negatively on China's regional sovereignty and violates international agreements. Beijing will not agree to India's unilateral decision regarding changing the legal status of the Kashmir region and the decision is unacceptable" (Anadolu 06/08/2019). China realizes that this strengthens India's position in the region, making India a competitor to China and a parallel regional power, which is what America aims for to confront China's regional power... especially since Ladakh in the Kashmir region is located on the Tibetan plateau near China. Although its population is small (about 270,000), solving the Kashmir issue in this manner and affecting the Ladakh region on the Sino-Indian border without consulting China has sparked criticism from China. If China can master its steps and develop its political awareness to exploit the situation of Ladakh to its advantage, it may turn the tables on America's plans. Instead of Ladakh being a forward operations base for American forces against China as America plans, it could be a pitfall into which those forces fall and never emerge!

  1. Finally, our calamity lies in the rulers in the Muslim lands. Our components of strength are sufficient—indeed, more than sufficient—to restore our rights with dignity and teach the enemy a lesson that will accompany it to its grave! But the rulers who have betrayed Allah, His Messenger, and the believers, bow down to their masters from the colonialist disbelievers far more than they bow down to Allah, the Lord of the worlds. They prevent the armies from fighting their enemies to liberate the occupied parts of their lands... then these rulers beg with humiliation and degradation for some crumbs in the corridors of the United Nations and the Security Council... that is, if they even get the crumbs! But despite all these tragedies, the occupied Muslim lands from Palestine to Kashmir, to Burma the land of the Rohingya, then East Turkestan, the Caucasus, Chechnya and its surroundings, Crimea, and every land where the Mu'adhin called the Takbir and was occupied by the enemies of Islam... all of them will return, by Allah’s permission, to the Dar al-Islam, with the banner of Islam fluttering over them... returned by the Imam, the shield... returned by the Rightly Guided Khalifah... returned by the mujahid army of Islam... So whoever loves dignity in this world and the highest Paradise (Al-Firdous al-A'la) in the Hereafter, let him roll up his sleeves and work with those working to establish the Khilafah, and let this work flow through his blood, heart, and limbs with sincerity and devotion...

إِنَّ هَذَا لَهُوَ الْفَوْزُ الْعَظِيمُ * لِمِثْلِ هَذَا فَلْيَعْمَلِ الْعَامِلُونَ

"Indeed, this is the great success. For the like of this let the workers [on earth] work." (QS As-Saaffat [37]: 60-61)
